Ensuring educational rights for children with special needs

Abstract
Ensuring educational rights for children with special needs (CWSN) is
crucial for inclusive education in India. This article investigates legislative
frameworks, including the Right to Education (RTE) Act of 2009 and the Rights
of Persons with Disabilities (RPwD) Act of 2016 that seek to provide fair
educational opportunities for CWSN. The RTE Act requires free and compulsory
education for all children aged 6 to 14, including CWSN, whereas the RPwD Act
broadens the definition of disability and emphasises the importance of
accessible infrastructure, teacher training, and curriculum changes. Despite
these legal protections, issues such as inadequate infrastructure, a scarcity
of skilled teachers, and societal shame continue. The study also discusses
current developments, such as the National Education Policy (NEP) 2020 and
initiatives like the DIKSHA platform, which seek to promote inclusive
education. The participation of parents, educators, and the community is
emphasised as critical to the successful implementation of inclusive education.
